The general Terms and Conditions that are stated herein, regulate the use of Medellín’s Official Travel Guide www.medellin.travel/en (“The Guide”), which allows users to interact and have access to informative data and educational information.

Individuals (subsequently referred to as “Users”) that use or access The Guide agree to the statements of rights and responsibilities stated herein. Consequently, the Users must read and comply with the Terms and Conditions every time the Guide is accessed.

These Terms and Conditions can only be partly or completely modified by the site administrator or owner. Any changes that are undertaken will come into effect the moment they are published, posted on the site, or notified to the Users by any means, whichever comes first. There will be no further notice provided to the Users, therefore, it is recommended that the Users review the Terms and Conditions regularly to avoid any violations. Violations to the Terms and Conditions stated herein will result in a suspension or termination in the use of The Guide, regardless of if this violation was committed through omission of the Terms and Conditions.

The Guide is owned by the Municipality of Medellín and is currently administered by the Fundación Medellín Convention & Visitors Bureau - Oficina de Convenciones y Visitantes de Medellín (“The Administrator”).

Services provided and information

The service provided in The Guide allows The Users to access all type of information related to tourism in the city of Medellín, including, among other items, texts, graphics, animations, videos, audio, photographs, as well as other types of information related to the topic of tourism on every level.

By no means is the information provided in The Guide intended to completely satisfy the needs of all Users. In some cases, the information in The Guide acts as a means for Users to access further information related to topics of interest.

The services provided by The Guide are free of charge for all Users. Nevertheless, some of the services may only be accessed by registered Users and free registration process may be required.  

Content responsibility

The owner of The Guide and The Administrator hold no responsibility for damages that may occur to Users or third parties through the use of information provided in The Guide. At the same token, The Guide is not responsible for the actions, content, information, or data of third parties or for the manner in which the information contained within the site is handled.

Due to the open nature of The Guide, The Administrator cannot guarantee control over third parties and the information provided/published on the Internet.

Therefore, neither the owner of The Guide nor The Administrator can guarantee the veracity and exact nature of all or part of the information published on the site, nor can it be verified that the information is updated and accurate, nor that this information has been altered or modified in any way subsequent to being included on the site, nor any other characteristic or aspect related to the information that has been published on the site or linked through it to other sites on the Internet.

The owner and The Administrator of The Guide attempt to keep it safe and free of viruses but Users use it at their own risk. Any programs, materials or information (“Downloads”) that have been placed in The Guide in order to be downloaded to a PC or any other type of electronic device that supports this type of practice, regardless of if The Guide, The Administrator or a third party have ownership, have been fully checked to verify that they don’t contain viruses or any other destructive elements. Notwithstanding, neither the owner nor The Administrator of The Guide can be held responsible for damages, losses, and expenses of any kind incurred through these practices. The Users are responsible for undertaking appropriate measures to ensure that their property is not damaged or infected in any way through viruses or any other destructive element that may come from The Guide.

The owner of The Guide and The Administrator will not be held responsible for the existence of viruses or any other destructive elements that could cause alterations to Users’ information systems (software and hardware), electronic documents, and files that have been stored on their information systems.
The owner of The Guide and The Administrator will not be held responsible for any damages, losses, or liability caused by alterations due to the Downloads that come directly from The Guide.

Content modification

The owner of The Guide and/or The Administrator reserve the right to modify and correct the content included in these Terms and Conditions of the site at any time and without notifying The Users. All rights that are not expressed in these Terms and Conditions are applicable by The Guide and/or The Administrator and, therefore, are reserved by the aforementioned parties. The Users that infringe the Terms and Conditions stated herein must submit to civil and penal sanctions that are established by law regarding national and international copyright.  

Information privacy

The collection and use of personal information is for the sole purpose of maintaining the relationship established between Users, the contents of The Guide and The Administrator, as well as administering, improving, and expanding the services provided for those registered Users.

The personal information collected allows for the services to be tailored according to the Users’ needs/tastes and assessed and evaluated accordingly so that new services can be designed. Additionally, access to the Users’ information allows for updates on technical information, operational changes, and commercial products and services offered in The Guide to be sent via email or traditional mailing systems to The Users.

The owner of The Guide and The Administrator have sole access to The Users’ information.

The Guide automatically receives general information such as the quantity and frequency of visitors to different sections of the site. This information is used solely for statistical purposes and helps to determine how many users access a specific area of the site, so that these particular areas can be improved and quality throughout the site ensured.

While The Guide is operating, statistical information is provided to the partnering institutions or those that depend on/are controlled by The Guide or The Administrator. The aim of this practice is so that the partnering institutions or those that depend on/are controlled by The Guide or The Administrator can observe how many Users visit different areas of the site so that the objectives of The Guide may be realized and the Users may receive the best possible experience.

Intellectual property

Intellectual property is understood as all types of information, messages, graphics, images, picture, designs, logos, names, brands, sound/image files, photographs, video/audio recordings, and, in general, any type of material that can be accessed via The Guide (“The Contents”).

The user shall:

• Legally use The Contents provided in an appropriate manner.
• Not reproduce, copy, distribute, transform or modify The Contents unless explicit authorization has been provided from the holder of the corresponding copyright.
• Not lift, surpass or manipulate copyright and other information related to copyright of The Guide such as its content and headlines as well as its technical and digital security  devices, or any other kind of technical information within the content.  
• Not use The Contents or any information that has been obtained from The Guide or any of its services for promotional means such as publicity or advertising.
• Not hold The Guide or The Administrator responsible for the incorrect/inappropriate use of the site and The Contents by third parties.
• Accept that the promotional ads and publicity that appear on the site are a part of The Guide and, therefore cannot be removed or surpassed in some cases.
• Not retransmit, reproduce or publish any of The Contents from The Guide in any type of format to third parties.
• Not publish or transmit any type of illicit material, or any content that could constitute a felony or infringement of the law, or any content that could be conducive to illicit conduct under Colombian laws.

Termination

The services provided through The Guide and any other additional services included herein have an indefinite duration. The owner of The Guide and/or The Administrator have the authority to suspend or terminate the services of The Guide, and any other additional services included herein, at any given time without affecting the statutory rights established in the Terms and Conditions. Whenever possible, the owner of The Guide and/or The Administrator will notify the suspension or termination of the services of The Guide and any other additional services included within.

Hyperlinks

If the User opts to create a hyperlink to The Guide and its contents, the User agrees to the following:

• If hyperlinks are used to provide direct access to the main site of The Guide, no explicit authorization is required.
• If deep links, embedded links, or frames are used to link specific content or a section from The Guide, then explicit authorization from the owner of The Guide or The Administrator must be solicited prior to creating these hyperlinks. The authorization to include these types of hyperlinks does not include the right to modify or change The Content, but it does include the right to mention the author of The Content—in this case The Guide—and add a link to the main site.
• The hyperlinks will not include mechanisms that confuse or hide copyright information from The Users.
• Any information or content that is under the Creative Commons license in The Guide must nevertheless abide by the rules established for this license when included in a hyperlink.

Laws and jurisdiction

These Terms and Conditions are in acquiescence with Colombian laws. The owner of The Guide and/or The Administrator and The Users agree to submit to the personal jurisdiction of the courts and tribunals located in the city of Medellín without regard to conflict of law provisions.

The Users release the owner of The Guide and The Administrator from any claims and damages, known and unknown, arising out of, or in any way connected to, any type of infringement or inappropriate use of copyright in any of The Contents included in The Guide.
